Làm việc dưới 3 tháng thì DN có phải đóng BHXH không ?

Tôi đang làm việc cho 1 cty xây dựng, hiện tại tôi làm hồ sơ để tham gia BHXH cho nhân viên trong công ty bên c ạnh đó chúng tôi còn thuê nhân công để xây dựng công trình có thời hạn dưới 3 tháng. Vậy tôi có phải đóng BHXH cho họ ko? Nếu không thì khi tôi đăng ký khai trình lao động trên sở LĐTBXH của quận tôi có cần kê khai những công nhân đó vào danh sách này ko?

 Theo Điều 2 Luật Bảo hiểm xã hội thì chỉ người lao động làm việc theo HĐLĐ có thời hạn từ 3 tháng trở lên mới thuộc đối tượng tham gia BHXH bắt buộc. Do đó, người lao động công ty bạn làm việc theo HĐLĐ dưới 3 tháng thì không phải tham gia BHXH bắt buộc mà tiền BHXH sẽ được tính trả vào lương cho họ. Tuy nhiên, bạn vẫn phải kê khai số lao động này với cơ quan quản lý nhà nước về lao
